Terms of Sale Seemned24.ee Online Store
These terms and conditions govern the legal relationship between GardenBee OÜ (hereinafter the Seller), the owner of the Seemned24.ee trading platform, and the person making a purchase (hereinafter the Buyer).
1. Seller Details
GardenBee OÜ (registry code 14883500)
Address: Ida-Viru maakond, Alutaguse vald, Kalina küla, Rikandi, 41312, Estonia
E-mail: info@seemned24.ee
2. Scope of Agreement
These terms apply to all sales transactions conducted at the Seemned24.ee online store. The Seller reserves the right to unilaterally amend these terms and prices.
3. Ordering and Entry into Force of the Agreement
- The sales agreement is deemed concluded (enters into force) upon receipt of the total amount due, as specified in the order confirmation, into the Seller's bank account.
- When placing an order, the Buyer is obliged to provide accurate data required for the fulfillment of the order. The Seller is not responsible for any failure to fulfill obligations due to incorrect data provided by the Buyer.
4. Prices and Payment
- All prices in the online store are in euros (€) and include the Value Added Tax (VAT) applicable in the Republic of Estonia.
- Orders are processed on a 100% prepayment basis.
- A delivery fee is added to the price of the goods, which is calculated in the shopping cart based on the selected method and region.
5. Delivery and Shipping Schedule
- To optimize logistical processes, the Seller applies the following schedule: orders paid for during the current calendar month are handed over to the delivery service between the 5th and the 15th day of the following calendar month.
- Delivery times depend on the selected logistics partner and the destination country.
- The risk of accidental loss or damage to the goods passes to the Buyer upon delivery to the Buyer or to the carrier (in B2B transactions). Consumers must inspect the integrity of the packaging upon receipt.
6. Right of Withdrawal and Exceptions
Pursuant to § 56 of the Law of Obligations Act (VÕS), the Consumer-Buyer has the right to withdraw from the transaction within 14 days of receiving the goods. However, pursuant to VÕS § 53 (4), the right of withdrawal does not apply to the following categories of goods:
- Goods made or ordered to the Buyer's personal specifications (products brought from the manufacturer's warehouse under a specific special order for the Buyer, including large quantities of goods that are not part of the Seller's standard stock and cannot be resold to other buyers within a reasonable time).
- Perishable goods (live plants, flower bulbs, seed potatoes, and other goods with a limited shelf life or those requiring specific temperature conditions).
- Goods in damaged or opened packaging. Seeds, bulbs, and garden chemicals are only accepted for return in their original, hermetic, and undamaged packaging. Opening the package makes it impossible to verify the preservation of the live product's quality.
The costs of returning the goods shall be borne by the Buyer, except where the goods do not match the order.
7. Disclaimer on Product Specifics (Live Product)
Seeds, bulbs, and potatoes are live biological materials. Their germination and productivity depend directly on the storage conditions provided by the Buyer, agricultural techniques, soil type, and climatic factors. The Seller guarantees that the goods meet quality standards at the time of transfer but is not responsible for the final growing result, which is beyond the Seller's control.
8. Claims Procedure
- The Seller is liable for any lack of conformity of the goods with the terms of the agreement that existed at the time of transfer.
- The Buyer must submit a claim to info@seemned24.ee no later than two months after discovering the defect, including photographs of the product and the packaging.
9. Liability and Force Majeure
The Seller is not liable for damage caused by improper use or storage of the goods by the Buyer. The Seller's liability is limited to the cost of the order in all cases.
10. Dispute Resolution
All disputes shall be settled through negotiations. If an agreement is not reached, the Consumer-Buyer has the right to contact the Consumer Protection and Technical Regulatory Authority (TTJA) or the Consumer Disputes Committee (komisjon.ee). Legal disputes shall be settled in Harju County Court.
